These terms and conditions of processing of personal data (hereinafter ‘Terms & Conditions’) describe how and for what purposes are personal data collected, processed and shared by Evenstad OÜ (hereinafter ‘Evenstad’ or ‘We’ or ‘Us’ or ‘Our’).

By using Our website, the Artificial Assistant on Our website or Our social media profiles, services or licences or by seeking contact with Us in any manner you agree to these Terms & Conditions. If you continue using Our website or the Artificial Assistant on Our website or Our social media profiles, services or licences or if you continue interacting with Us, you are considered as having agreed to these Terms & Conditions.

Should you not agree to these Terms & Conditions, you will have no right to use Our website or the Artificial Assistant on Our website or Our social media profiles, services or licences or to continue interacting with Us.

We as processor process personal data on your behalf as controller. According to the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council), these Terms & Conditions include provisions governing the processing of personal data.

We are obligated to process personal data only in accordance with applicable legislation, these Terms & Conditions and instructions from you as the controller. Our obligations as to personal data as provided by these Terms & Conditions are also your instructions to Us for the processing of personal data. In terms of processing of personal data not governed by the contract We are guided by your additional written instructions or, if you have not provided any, by law.

You hereby give Us a general written permission to engage processors. We will inform you of such engaged processors. We will only engage processors from the European Economic Area.

We are obligated to guarantee the confidentiality of any personal data provided to Us by you for processing and We will ensure that all persons authorised to process personal data are subject to the obligation of confidentiality.

We are obligated to take and help you as the controller to take any and all appropriate technical and organisational measures to ensure the security of the personal data processed, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing.

We will assists you by appropriate technical and organisational measures, insofar as this is possible, for the fulfilment of the controller’s obligation to respond to requests for exercising the data subject’s rights.

At your choice, We will delete or return to you all the personal data, which We as processor process on your behalf, after the end of the provision of services relating to processing, unless the law requires Us to store the personal data.

At your request, We will make available to you all information necessary to demonstrate compliance with the requirements for processing of personal data.

Should We become aware of a breach related to personal data processed on your behalf, We will notify you without undue delay and set out the following:

  • the nature of the personal data breach, the categories and approximate number of data subjects concerned and the categories and approximate number of personal data records concerned;

  • the name and contact details of the data protection officer or other contact point where more information can be obtained;

  • the likely consequences of the personal data breach;

  • the measures taken or proposed to be taken by Us to address the personal data breach or measures to mitigate its possible adverse effects.

We will process personal data obtained from you for providing Our services to you under contracts concluded with you and for contacting you. To this end, personal data are collected, recorded, organised, adapted, altered, transmitted and stored. You understand that you will provide personal data to Us freely. Personal data processed are names, personal identification codes, e-mail addresses and other data that you provide. In this context of processing, data subjects mean your employees and representatives and users of your website.
